3. Payments

If you wish to postpone rather than cancel, we will try to reschedule within a reasonable period, but availability cannot be guaranteed. Where a postponement causes significant disruption to the planned programme, we may need to reissue the quotation or adjust the prices to reflect revised costs. We are not liable for any indirect losses arising from a cancellation or postponement, including inconvenience, loss of use, or third-party charges.

We may cancel or suspend services if you fail to provide access, if payment is overdue, if the site becomes unsafe, or if events outside our control make performance impracticable. In such circumstances, we will normally give notice where reasonably possible. If we cancel for reasons within our control before work starts, any advance payment for undelivered work will be refunded, excluding amounts properly due for materials already committed or services already performed.

5. Liability, Site Safety and Insurance

6. Waste, Green Waste and Environmental Requirements

We will use reasonable care, but we cannot accept responsibility for damage caused by undisclosed or inaccurately marked services.

If adverse weather, frozen ground, waterlogging, extreme heat, or other site conditions make it unsafe or impractical to continue, we may pause the project and return when conditions improve. Weather-related interruptions do not constitute a breach of contract. Any agreed completion target may be extended accordingly, and any additional mobilisation or remobilisation costs may be charged where fair and reasonable.

8. Complaints, Defects and Rectification

9. Governing Law

The parties agree that the courts of England and Wales shall have exclusive jurisdiction, except where mandatory consumer law provides otherwise.

These terms are intended to support fair dealing and clarity for both parties in relation to landscaping services. If a court or competent authority determines that any clause is invalid or unenforceable, that clause shall be severed to the minimum extent necessary, and the remainder of the terms shall continue to apply.
